Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the RaceData website (racedata.app) and the RaceData platform (together, the “Service”). By creating an account, signing in, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

The Service is operated by RaceData, located at 15800 Pines Blvd, Suite 3015, Pembroke Pines, Florida 33027, United States (“RaceData”, “we”, “us”, “our”). You can contact us at [email protected].

2. The Service

RaceData is a web platform for the management of racing teams: timing, data acquisition, tyres, setup, video, sporting reports and related operations. The features available to you depend on the plan you subscribe to. We may improve, add or remove features over time; where a change materially reduces the Service you pay for, we will notify you in advance.

3. Accounts and sign-in

To use the platform you need an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use of your account. You are responsible for all activity under your account.

You may register or sign in using a third-party identity provider such as Google Sign-In. When you do, you authorize us to receive basic profile information from that provider (such as your name and email address) to create and operate your account, as described in our Privacy Policy. We never receive or store your Google password.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. Accounts created on behalf of a team or company bind that organization to these Terms, and the person creating the account confirms they are authorized to do so.

4. Plans, billing and free trial

Paid plans are billed as described on our pricing page. Prices are stated in US dollars and may change; price changes apply from the next billing cycle after notice. Promotional pricing (such as launch promotions) applies for the period stated in the offer.

New accounts may include a free trial for the period indicated at sign-up, with no credit card required. When the trial ends, access to the platform is suspended until you subscribe to a plan; your data is retained for a reasonable period so you can resume service.

Unless required by law or expressly stated otherwise, fees are non-refundable. You can cancel at any time; cancellation takes effect at the end of the current billing period.

5. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of these Terms;
• interfere with, disrupt or attempt to gain unauthorized access to the Service, other accounts, or our infrastructure;
• reverse engineer, decompile or copy the Service, except where permitted by law;
• resell, sublicense or provide the Service to third parties outside your team or organization without our written consent;
• upload content that is illegal, infringing, or malicious (including malware or code intended to damage the Service).

We may suspend accounts that put the Service, other users or third parties at risk, notifying you where reasonably possible.

6. Your data and content

You retain all rights to the data and content you upload to the platform (telemetry files, lap times, setup sheets, video, documents and any other team data, “Customer Data”). You grant us a limited license to host, process and display Customer Data solely to provide and support the Service.

You are responsible for having the necessary rights over the Customer Data you upload. We handle personal data as described in our Privacy Policy. Upon account termination you may request an export of your Customer Data within the retention period stated there.

7. Intellectual property

The Service, including its software, design, branding and documentation, is owned by RaceData or its licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. No rights are granted other than those expressly stated.

8. Third-party services

The Service may interoperate with third-party services (for example Google Sign-In, timing providers or payment processors). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

9. Availability and support

We work to keep the Service available and performant, but we do not guarantee uninterrupted or error-free operation. Maintenance windows, updates or events beyond our reasonable control may cause temporary interruptions. Support channels and response targets depend on your plan.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Motorsport decisions (including safety-related decisions) remain your sole responsibility; the Service provides data and analysis tools, not racing advice.

11. Limitation of liability

To the maximum extent permitted by law, RaceData will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or related to the Service is limited to the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim.

12. Termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access if you materially breach these Terms and do not cure the breach within a reasonable period after notice, or immediately in case of serious misuse. Sections that by their nature should survive termination (including 6, 7, 10, 11 and 14) survive.

13. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you (for example by email or an in-app notice) before it takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules. Any dispute arising out of these Terms or the Service will be submitted to the competent courts located in Broward County, Florida, unless mandatory law provides otherwise.
